GENERAL TERMS AND CONDITIONS OF SERVICE

Mercado Hogar operates in Ontario, Canada and provides online retail, personal shopping, package receiving, shipment coordination, logistics coordination, and related services. By purchasing products, requesting services, delivering goods for transportation, or using any service offered by Mercado Hogar, the Customer agrees to be bound by these Terms and Conditions.

  1. DEFINITIONS

“Customer” means any person or entity using Mercado Hogar’s services.

“Goods” means any merchandise, package, cargo, document, or item entrusted to Mercado Hogar.

“Consignee” means the intended recipient of the shipment.

“Shipment” means any package, cargo, merchandise, or goods delivered for transportation, storage, handling, or distribution.

  1. ACCEPTANCE OF TERMS

Use of any Mercado Hogar service constitutes acceptance of these Terms and Conditions.

  1. NATURE OF SERVICES

Mercado Hogar may provide:

  • Online retail services;
  • Personal shopping services;
  • Package receiving services;
  • Shipment coordination services;
  • Logistics coordination services;
  • Storage coordination services;
  • Freight forwarding coordination services;
  • International shipping services;
  • Related logistics and fulfillment services.
  1. THIRD-PARTY SERVICE PROVIDERS

Mercado Hogar may engage airlines, freight forwarders, trucking companies, ocean carriers, warehousing providers, customs brokers, logistics operators, distribution companies, and other authorized third-party providers to perform all or part of the contracted services.

  1. NO GUARANTEE OF SPECIFIC PROVIDERS

Mercado Hogar may select, substitute, or change service providers at its discretion.

  1. NO CARRIER STATUS

Unless expressly stated otherwise, Mercado Hogar does not operate aircraft, vessels, rail services, or commercial transportation fleets and does not act as a common carrier.

  1. CUSTOMER INFORMATION

The Customer warrants that all information provided is accurate, complete, and truthful.

  1. RIGHT OF REFUSAL

Mercado Hogar may refuse any shipment, order, or service that presents legal, operational, safety, or regulatory concerns.

  1. INSPECTION OF GOODS

Mercado Hogar may open, inspect, photograph, weigh, measure, scan, or verify shipments when required by law, security procedures, or operational needs.

  1. WEIGHT AND DIMENSIONS

Charges may be based on actual weight, volumetric weight, or chargeable weight.

  1. PACKAGING

The Customer is responsible for proper packaging of all goods.

  1. PROHIBITED GOODS

Mercado Hogar shall not accept prohibited goods, including but not limited to:

  • Weapons;
  • Ammunition;
  • Explosives;
  • Narcotics;
  • Cash;
  • Counterfeit products;
  • Illegal goods;
  • Radioactive materials;
  • Restricted items prohibited by applicable law.
  1. DANGEROUS GOODS

The Customer warrants compliance with:

  • Transportation of Dangerous Goods Act (Canada);
  • TDG Regulations;
  • IATA Dangerous Goods Regulations;
  • ICAO Technical Instructions;
  • Transport Canada requirements;
  • Applicable customs and aviation security regulations.

The Customer assumes full responsibility for undeclared dangerous goods.

  1. LITHIUM BATTERIES

Lithium batteries, power stations, and regulated electronics may be refused or subject to special requirements.

  1. FRAGILE ITEMS

Fragile items travel at the Customer’s risk unless additional protection has been purchased.

  1. ELECTRONIC EQUIPMENT

Electronic items may be transported subject to applicable limitations and handling requirements.

  1. ONLINE STORE

Product descriptions, images, specifications, and availability are subject to change without notice.

  1. PRODUCT AVAILABILITY

All products are subject to availability.

  1. PERSONAL SHOPPING SERVICES

Mercado Hogar acts as a purchasing agent and does not manufacture products sold through its services.

  1. PRICING AND PAYMENT

All services and products must be paid in accordance with applicable rates and pricing.

  1. FINAL SALE POLICY

Except where prohibited by law, all sales are final once processing has commenced.

No returns, exchanges, or refunds shall be provided after processing, fulfillment, dispatch, or shipment preparation.

  1. ORDER CANCELLATIONS

Orders may only be cancelled before processing begins.

  1. PRODUCT WARRANTIES

Manufacturer warranties, if any, remain the responsibility of the manufacturer.

  1. PRICING ERRORS

Mercado Hogar may cancel orders resulting from pricing, inventory, typographical, or system errors.

  1. TRANSIT TIMES

Transit times are estimates only and are not guaranteed.

  1. INTERNATIONAL AIR TRANSPORTATION

Liability during international air transportation shall be governed by the Montreal Convention of 1999 and the applicable carrier’s conditions of carriage.

  1. AIR CARGO SECURITY

All shipments may be subject to security screening, inspections, and verification procedures.

  1. LIABILITY DURING STORAGE AND GROUND TRANSPORTATION

For loss or damage occurring while goods are under Mercado Hogar’s direct custody during storage, consolidation, handling, or ground transportation, liability shall be limited to the lesser of:

  • Declared value;
  • Proven value;
  • CAD $100.00 per shipment.

Unless additional coverage has been purchased.

  1. OPTIONAL PROTECTION COVERAGE

Additional protection may be available upon request and subject to written confirmation.

  1. GOVERNMENT ACTIONS

Mercado Hogar is not responsible for delays, inspections, seizures, confiscations, or actions taken by customs or governmental authorities.

  1. CUSTOMS DUTIES AND TAXES

All duties, taxes, customs fees, and governmental charges remain the responsibility of the sender or consignee.

  1. INTERNATIONAL SHIPMENTS AND CUBA

The Customer acknowledges that customs, governmental agencies, cargo terminals, and distribution entities in destination countries operate independently from Mercado Hogar.

Mercado Hogar does not guarantee customs clearance, delivery dates, or door-to-door delivery availability.

  1. DELIVERY

Deliveries may be completed through residential delivery, pickup centers, distribution facilities, cargo terminals, or authorized collection points.

  1. THIRD-PARTY CARRIERS

Transportation and delivery may be performed by independent service providers.

  1. NO REFUND POLICY FOR INTERNATIONAL SHIPMENTS

No refunds shall be issued for:

  • Customs delays;
  • Regulatory delays;
  • Carrier delays;
  • Additional charges assessed by authorities;
  • Recipient refusal;
  • Failure to pay destination charges;
  • Government detention or seizure.
  1. CLAIMS

Claims must be submitted in writing within seven (7) calendar days of delivery.

  1. CLAIM DOCUMENTATION

Claims must include proof of value, photographs, shipment documentation, and any supporting evidence requested.

  1. STORAGE

Additional storage charges may apply.

  1. ABANDONED GOODS

Goods not claimed within ninety (90) days may be deemed abandoned.

  1. PHOTOGRAPHIC RECORDS

Mercado Hogar may photograph and document shipments for operational and evidentiary purposes.

  1. PRIVACY

Personal information shall be handled in accordance with PIPEDA and applicable Canadian privacy legislation.

  1. INDEMNIFICATION

The Customer agrees to indemnify and hold harmless Mercado Hogar from claims, penalties, fines, losses, damages, costs, and legal expenses arising from inaccurate declarations, regulatory violations, prohibited goods, or dangerous goods.

  1. FORCE MAJEURE

Mercado Hogar shall not be liable for events beyond its reasonable control.

  1. RIGHT OF LIEN

Mercado Hogar may retain goods for unpaid charges or outstanding obligations.

  1. RIGHT OF SET-OFF

Mercado Hogar may apply credits or funds owed against outstanding balances.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Mercado Hogar’s total liability shall not exceed the limits expressly established in these Terms and Conditions.

  1. GOVERNING LAW

These Terms shall be governed by the laws of Ontario and the applicable federal laws of Canada.

  1. JURISDICTION

The courts of Ontario shall have exclusive jurisdiction.

  1. DISPUTE RESOLUTION

The parties shall attempt good-faith negotiation prior to commencing legal proceedings.

  1. ELECTRONIC SIGNATURES

Electronic acceptance, online acceptance, digital signatures, and website acknowledgements shall have the same legal effect as handwritten signatures.

  1. CUSTOMER’S INDEPENDENT DECISION TO CONTRACT

The Customer confirms that they contacted Mercado Hogar voluntarily and independently and were not improperly solicited.

  1. CONFIDENTIAL INFORMATION

Mercado Hogar does not solicit or use confidential information belonging to third parties.

  1. WEBSITE POLICIES

Any Refund Policy, Privacy Policy, Shipping Policy, Pickup Policy, or other policy published on the Mercado Hogar website forms part of these Terms and Conditions.

  1. ENTIRE AGREEMENT

These Terms constitute the entire agreement between Mercado Hogar and the Customer.

  1. MODIFICATIONS

Mercado Hogar reserves the right to amend these Terms and Conditions at any time by posting updated versions on its website.
