Mercado Hogar operates as:

A logistics coordination service offering pickup and shipment of packages, including international shipments (e.g., to Cuba)
Mercado Hogar does not act as a carrier. All transportation is performed by independent third-party service providers.
3. Orders and Purchases
All orders are subject to:
Product availability
Payment confirmation
Acceptance by Mercado Hogar
Orders may not be modified or canceled once they have entered processing.
4. Final Sale Policy (Binding)
All products and services offered by Mercado Hogar are considered final sale.
No returns
No exchanges
No refunds
Once:
The order has entered processing, or
The shipment has been prepared or dispatched
This condition is strict and non-negotiable.
5. Pickup Services
Where applicable, Mercado Hogar offers pickup services at the Client’s address.
The Client agrees:
Packages must be ready, properly packed, and accessible
Accurate declaration of contents and value is mandatory
Missed pickups may result in additional charges
6. Shipping and Third-Party Carriers
All shipments are handled by independent third-party carriers, including but not limited to:

Correos de Cuba (EMCI)
Cubapack
The Client acknowledges:
Mercado Hogar has no operational control over these entities
Each carrier operates under its own terms
7. Delivery Process in Cuba (Critical Clause)
The Client expressly understands that all operations within Cuba are outside Mercado Hogar’s control.
Once shipments arrive in Cuba:
Customs authorities determine clearance
Cargo terminals manage handling
State distribution companies manage final delivery
Possible outcomes include:
Home delivery (if available)
Pickup at local distribution center
Pickup at airport cargo terminal
Mercado Hogar does not guarantee:
Delivery timelines
Door delivery availability
Release by customs
8. Customs Duties and Charges
All customs duties, taxes, and fees in Cuba:
Are NOT included in the purchase price or shipping cost
Must be paid by the recipient locally
Mercado Hogar:
Has no control over such charges
Is not responsible for any amounts assessed
9. No Guarantee of Delivery Times
All transit times are estimates only.
Mercado Hogar is not responsible for delays caused by:
Customs
Government regulations
Transportation issues
Force majeure events
10. Risk and Liability for Shipments
All shipments are transported at the Client’s own risk.
Mercado Hogar is not liable for:
Loss
Damage
Delay
Seizure by customs
Any claims must be made directly with the third-party carrier.
11. No Refund Policy for Shipments (Cuba Specific)
Due to the regulatory and operational environment in Cuba:
No refunds will be issued for:
Delays in customs clearance
Delays in local delivery
Additional charges imposed at destination
Recipient refusal or inability to pay customs
Seizure or retention by authorities
12. Incorrect Information
The Client is responsible for providing accurate information.
Mercado Hogar is not responsible for:
Delivery failures due to incorrect details
Additional costs resulting from errors
13. Unclaimed or Refused Shipments
If a shipment is refused, abandoned, or not claimed:
No refund will be issued
Any additional costs are the responsibility of the Client
14. Client-Origin and Voluntary Contact
By accessing this website, contacting Mercado Hogar, requesting information, or placing an order for services, the Client expressly acknowledges, represents, and confirms that they have approached Mercado Hogar entirely on their own initiative, voluntarily, and without having been subject to any direct solicitation, targeted outreach, inducement, or encouragement by Mercado Hogar, its owners, employees, contractors, or representatives.
The Client further acknowledges and agrees that their decision to engage with Mercado Hogar is made independently and is not the result of any action intended to influence, solicit, or encourage the Client to transfer or discontinue services with any other company, service provider, or third party.
The Client expressly represents that initiating contact with Mercado Hogar and/or engaging its services does not violate any existing contractual obligations, non-solicitation agreements, confidentiality agreements, or other legal restrictions to which the Client may be subject.
Mercado Hogar shall not be held responsible or liable for any breach by the Client of such obligations. The Client agrees to indemnify and hold harmless Mercado Hogar, its owners, affiliates, and representatives from and against any and all claims, demands, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of or related to any such breach.
By proceeding with the use of services, the Client confirms their full understanding and acceptance of this clause.
15. Privacy
Personal data is handled in accordance with Canadian privacy laws, including PIPEDA.
16. Limitation of Liability
To the maximum extent permitted by law:
Mercado Hogar’s total liability shall not exceed the amount paid by the Client.
Mercado Hogar shall not be liable for:
Indirect or consequential damages
Loss of income, business, or opportunity
17. Governing Law
These Terms shall be governed by the laws of the Province of Ontario and applicable Canadian law.
18. Changes to Terms
Mercado Hogar reserves the right to update these Terms at any time.
